The Office of the Attorney-General has withdrawn all criminal charges against Mildred Donkor, the third accused person in an ongoing case before the Accra High Court, according to a notice filed on October 16, 2025.
In a "Notice of Withdrawal from Prosecution" filed at the Superior Court of Judicature in the High Court (General Jurisdiction), the Attorney-General exercised powers under Section 59 of the Criminal and other Offences (Procedure) Act, 1960 (Act 30) to discontinue prosecution against Donkor.
The document, signed by Hon. Dr. Justice Srem-Sai, Deputy Attorney-General, states: "TAKE NOTICE that the Honourable Attorney-General has, pursuant to Section 59 of the Criminal and other Offences (Procedure) Act, 1960 (Act 30), withdrawn MILDRED DONKOR, the 3rd Accused Person herein, from prosecution in respect of all the charges brought against her in this case."
The case, filed under Suit No. CR/0418/2025, involves four accused persons:
The Republic of Ghana is the plaintiff in the criminal matter.
The withdrawal was dated and filed at the Office of the Attorney-General at The Law House on Liberia Road, Accra, on October 15, 2025, and officially stamped by the High Court Registry on October 16, 2025, at 3:00 pm.
Section 59 of Act 30 grants the Attorney-General the constitutional authority to enter a nolle prosequi (a formal notice of abandonment) in any criminal proceedings before judgment is delivered, effectively terminating the prosecution against the accused person.
The notice is to be served on the remaining accused persons or their legal representatives.
Sources close to the case indicate that the charges against Donkor were withdrawn after she voluntarily elected to testify against the first accused person, Kwabena Adu-Boahene, and the other co-accused in the matter.
This arrangement, commonly known as turning state witness or entering into a plea agreement, allows prosecutors to secure testimony from an insider to the alleged offenses in exchange for dropping charges against that individual.
With this withdrawal, Mildred Donkor is no longer facing prosecution in this matter, and all charges against her have been dropped. However, she is expected to provide testimony for the prosecution against the three remaining accused persons: Kwabena Adu-Boahene, Angela Adjei Boateng, and Advantage Solutions Limited.
Her testimony as a former co-accused could prove crucial to the State's case, as she may have direct knowledge of the alleged criminal conduct.
This is a developing story. Further details about the specific nature of the charges were not immediately available.
